General terms and conditions and important customer information

As of July 2005

1. General
The following general terms of business are applicable to all contracts, deliveries and other services. We herewith expressly dissent any divergent regulations of the contracting partner. No oral supplements to these general terms and conditions have been made. Any changes, amendments and waivers require written form and our confirmation in order to be valid.

2. Time of the contract conclusion
By clicking the "Bestellung abschicken" button a binding order is issued for the goods contained in the shopping cart. The confirmation of the receipt of the order follows immediately after sending the order. The contract of purchase results from our delivery confirmation or the delivery of the goods.

3. Inspection of the contract text
The contract text is saved. The general conditions of the contract are open to inspection any time on this website. For safety reasons, your precise order data are not retrievable from the internet.

4. Right of withdrawal
In the terms of §13 BGB (German civil law), as a consumer, you are not bound to the order you made if the order is withdrawn within a period of 2 weeks upon receipt of the goods.
The withdrawal does not need to be substantiated. It can take place in written form (e-mail is sufficient) or by returning the good at our own risk. Observance of the time limit will be given by the timely return of the goods to the following address:

Please affix sufficient stamps to the parcel to avoid excess postage. The cost of postage will be refunded to you immediately.
In case you cannot send back the goods or parts of the goods, or if you can send the goods back only in bad state, then you will have to pay compensation of the value of the goods. This can be avoided by simply inspecting the goods as you would do in a retail shop and sending them back without any signs of use and in the original packaging.
We will take over the cost of return consignment if your order exceeds an amount of 40,00 EUR.

Excluded from the return are:

• goods which have been manufactured on customer specification or are unambiguously tailored to personal requirements or are not suitable for a return because of their state,
• vehicles which were modified and/or adapted,
• audio or video recordings or software, if the delivered data processing media have been unsealed by you,
• Books, newspapers, and magazines

5. Claims
Claims because of wrong or false delivery must be reported to us in writing within 7 days upon receipt of the consignment. Upon request, the customer will receive subsequent delivery, exchange, credit or repayment.

6. Warranty
Warranty is subject to the statutory regulations. In case of damage we normally first re-deliver the goods or improve the delivery. If this fails or if the newly delivered goods are again damaged, you can return the goods and you will be refunded the full purchase price. Information on possible manufacturer guarantees can be found in the product documentation.
Please note that the warranty expires in case of rebuilding and/or tuning of slotcars and accessories. Please take notice of the product information on the packaging of the manufacturers.

7. Delivery and payment
The delivery and payment terms of "Henkel & Nink Modellspielwaren G.b.R." are specified in more detail on this website below (Prices and payment, Shipping fees), on our main website (Liefer- und Versandkosten) in the order form.
There is no minimum order quantity but a minimum order value of 25,00 € (for deliveries within Germany) or 100,00 € (for deliveries in other countries).
In case our customers wish special forwarding the normal additional costs will be charged and notified in the order confirmation.

The estimated delivery time can be found in the product description. If no special information is given, the delivery takes place with order acceptance and payment.
Normally all articles which are offered in the on-line shop are immediately available. In any case you will receive an our order confirmation by e-mail. If necessary we will inform you in this e-mail if an article should not be available immediately.

8. Retention of title
Until they are entirely paid the goods remains a property of "Henkel & Nink Modellspielwaren G.b.R.". The buyer may not dispose of the retained goods or carry out other actions which could impair the protection of the seller. If the protection of the seller exceeds his claim with more than 20%, the seller will release securities of his own choice. In case third parties access to the retained goods the buyer will point out the property of the seller and immediately inform the seller. Upon behavior of the buyer contrary to the terms of the agreement, in particular delay of payment, the seller is entitled to take back the retained goods or if necessary to require the assignment of the restitution claims of the buyer against third parties. Recovery and garnishment of the retained goods by the seller do not result in the resignation of the contract as long as the repayment law is not applied.

9. Privacy notice
Your stock data are used solely to execute your order. All customer data are stored and processed under consideration of the relevant regulations of the federal privacy law (Bundesdatenschutzgesetz BDSG) and the teleservice data protection law (Teledienstdatenschutzgesetz TDDSG).

At any time you are given the right to receive information of your data stored. You may have them corrected, blocked or deleted. Please call us or send us your request by mail or fax.

We will not transmit your personal data including your address and e-mail address without your explicit and anytime revocable consent to third parties. Exempt from this rule will be our service partners who require the transmission of data to execute the order (e.g. the company in charge with the delivery of the goods and the financial institution in charge of the payment settlement). In these cases the extent of the transmitted data will be restricted to the necessary minimum.

In this shop information about your customer data is stored in cookies merely at your request in order to be available during your next visits of the website. The data stored in a cookie make it unnecessary for you to repeatedly fill in the forms. You can define whether you want to accept cookies of this website or not in the options menu of your browser.

10. Legal venue
Place of fulfilment and legal venue for both parties is Bad Homburg v.d. H. Solely German law is applicable

You can order by eMail, letter, fax, telephone or directly in our on-line shop.

Prices and payment

All specified prices are final prices in euro (€) and contain 19% VAT. Invoices are to be paid immediately

Deliveries into countries outside the European Community are not subject to VAT.
The prices valid on the date of delivery will be charged.

Payments have to be made either in advance, by cash on delivery (COD) or by automatic account debit.
New customers with first order shall pay only in advance or by cash on delivery (possible in Germany and Austria).
Further orders by foreign customers: precash or cash on delivery is possible in Germany, Austria and Switzerland, customers from other countries pay precash.

Precash
The invoice amount is to be paid in full. The buyer shall bear all bank charges (international transfers). In case of transfers from foreign
countries, under the new EU regulation, domestic transfer fees shall be raised under the following conditions

• usage of the EU standard payment form
• Indication of our BIC: FFVB DE FF
• Indication of the EBAN of our bank: DE 05 501 9 0000 600 137 0543

Cash on delivery
Cash on delivery is possible in Germany and Austria, additional fee: 6,50 EUR

Automatic bank debit
Automatic bank debit is possible with german banks only. Details of procedure are described in our order confirmation. The buyer shall bear all bank charges.

Shipping fees

Important notice
As the weight of all our articles has not been established or registered in our electronic system, the forwarding expenses indicated in the order process
might be incorrect. In particular for international shipping the weight of the parcel is an important factor.
The forwarding expenses are valid according to the following table. In case the forwarding expenses specified in the order are different, we will inform
you in separate e-mail. You will be free to accept these conditions or or to withdraw your order.
